With advances in technology and investment, electric bikes in the UK have come on leaps and bounds in recent years, making them one of the easiest ways to get around and revolutionising the way we approach commuting and outdoor activities.

Understanding Electric Bikes in the UK: Legality

Do I need a license to ride an e-bike?

For the majority of electric bikes, there is no requirement for any form of license. A license becomes necessary only when the bike features a motor exceeding 250W or an assisted speed surpassing 15.5mph.

Fortunately, regulations are more straightforward when it comes to electric bicycles equipped with electric motors, commonly known as EAPCs (Electrically Assisted Pedal Cycles).

The key criteria for defining an ebike or EAPC include:

  • Motor output not exceeding 250W continuously.
  • Maximum speed assistance up to 15.5mph.
  • Rider must be over 14 years of age.
  • Pedals must be actively in use for assistance to engage.

In practical terms, this implies that the motor provides assistance only up to 15.5mph, after which it disengages, requiring the rider to continue pedalling for further acceleration. This feature proves particularly advantageous for urban commuting, facilitating quicker acceleration from traffic lights and instilling added confidence in more cautious riders.

Can I make my e-bike go faster than 15.5mph?

Modifying or derestricting an electric bike (e-bike) in the UK is generally not legal. E-bikes sold in the UK must comply with specific regulations, including maximum power and speed limits, to be classified as Electrically Assisted Pedal Cycles (EAPCs).

Derestriction: Modifying an e-bike to go beyond these specified limits, commonly known as derestricting, is likely to render the bike non-compliant with legal standards.

Legal Consequences: Derestricting an e-bike can have legal consequences, including fines and penalties. Riding a derestricted e-bike may also lead to issues with insurance coverage.

Manufacturer’s Warranty: Derestricting an e-bike may void the manufacturer’s warranty, as it involves alterations to the original specifications.

Can my bike be powered by throttle?

Since the 1st of January 2016, the UK’s EAPC legislation (as highlighted above) allows only specific types of throttles on electrically assisted pedal cycles (EAPCs). These throttles may assist the rider (without the need for pedalling) but only up to a speed of 3.7 mph. When the rider is not actively pedalling and exceeds this speed, the throttle is designed to automatically cut power from the motor. However, if the rider is simultaneously pedalling, the throttle can offer assistance up to a maximum speed of 15.5mph.

Do I need insurance to ride an electric bike?

In the UK, Electrically Assisted Pedal Cycles are not legally required to have insurance. EAPCs are classified as bicycles, provided they meet specific criteria mentioned earlier in this post* meaning there is no need for insurance. However, riders should be aware that using an e-bike irresponsibly or modifying it to exceed regulations, may impact their liability in the event of an accident. While insurance is not mandatory, responsible riding and the following of the rules of the road are necessary to protect the rider from potential litigation.
